Abstract:

Statement of the Problem: In recent years, the use of Microbiome and their metabolites for clinical diagnostics and as therapeutics has gained increased attention as modes of treatment for various disorders. This has led to many start-up companies conducting clinical trials for various chronic diseases; as diverse as IBD and liver diseases. In spite of vast progress in this field, one of the major concerns for researchers is securing the Intellectual property rights (mainly patents) on Microbiome inventions (Bacteria, Viruses, and Fungi) that are categorized as naturally occurring products and therefore come under the Judicial exception of 35 U.S.C 101. In the present talk, I will discuss a few patents which have been successfully granted and are commercialized. Additionally, this talk will also cover the regulatory challenges associated with the use of live microbiome as biotherapeutics with recent trends and solutions.
